The irony in all of this mess is the guy responsible with coming up with a "fair and equitable" solution has lied to us three times. How is he still a credible arbitrator? Preceding your own self imposed deadlines with an "at the earliest" or the even more fashionable "in a best case scenario" would have made all the difference. You would think a lawyer would be familiar with these simple techniques.
