Default FAA violation

I am filling out a job application that asks, "In the past 10 years have you been convicted, been arrested, been on probation, or parole?" I have an FAA violation. I don't think this is a conviction but I'm not sure. Anyone have any insight?

FAA actions are civil, not criminal.

Check no.

I would also say no.

As a general rule there are two types of FAA violations; legal enforcement actions, and administrative enforcement actions. The penalty for the first is considered a "sanction" (which may include a license revocation or suspension), while the penalty for the second usually involves a Warning Notice or a Letter of Correction, and is generally considered even less serious than the first. In both cases, you are talking about a "civil" violation, and not a "criminal" violation. If your "violation" is either a legal enforcement action of an administrative enforcement action, check "no."

Disclaimer: I am licensed to practice law in multiple jurisdictions, but not in all jurisdictions. You may wish to consult local counsel.

Thanks for the replies. I know something like a speeding ticket is considered a conviction so I was concerned an FAA violation could mean the same.

Even a speeding ticket can depend on what state.

But the answers you received are correct: an administrative penalty, such as what the FAA hands out, is not a conviction.

Hi!

A simple speeding ticket IS a conviction, but it is NOT a Felony or a Misdemeanor.
Typically, applications ask for:
1-Convictions: Felony/Misdemeanors
2-Traffic Violations: Speeding, etc.
3-DUIs/DWIs (may be in category 1- above)
4-FAA "problems"
