Default Positioning Legs under Pt 91 or 135?

Can positioning legs to pick up passengers be operated under FAR Pt 91 or must the operator adhere to Pt 135 rules? This is NOT a duty or crew rest question, rather must the crew adhere to the Pt 135 60% landing distance rule when positioning to an airport for a passenger pick up?

Our company manual explicitly states the Part 135 regs from which we have relief when repositioning the airplane, the 60% rule being one of them.

The 135 outfit I used to fly for did these legs completely pt 91.

Should say what can be considered part 91 somewhere around the compliance statement in your GOM
