FMS Nav Data Base currency

Hello folks.
Here is the scenario:
You are in Europe, Part 91, with a route that takes you through the NAT and MNPS airspace back to the US.
Your FMS Nav database expires before you leave.
Are you legal to depart for this flight?
My CP says "yeah sure, as long as you check all your fixes and have current charts".
I seem to remember somewhere it says that for flights across the North Atlantic you cannot depart with an expired database. But I cannot find where that document is that states this.

I took an International Nav course and I wanna say the Instructor said something like that for Part XX.?- but with some strings attached. I look for that old notebook.
