Unless they put you on rest on your 3 Res days, you just got an early Christmas Present... You can't start a RAP or FDP unless you have 30 hours of prospective rest within the Previous 168, which you apparently don't (with the aforementioned caveat).

You might consider Yellow slipping on those 3 days to ensure you keep it that way.

Umm, yes but.... if you had training then a flight you would need the 30 in 168. I don’t think it works the other way around.

Correct. Because training is not considered a RAP nor an FDP, the 30/168 requirement would not apply.

Sick time as rest, GS denial, reserve pilot

Does sick time count as rest for 30/168? Since it is "free of duty," I'm assuming that to be the case. However, I received a voicemail from scheduling saying that I was denied a GS due to 30/168 violation and "less than 10 hours of rest before report violation." I have picked up GS rotations with less than 10 hours to report on my off days, but I have not done so on a long call day. Is there a difference for the 10 hours of rest before report?

20OCT: PR 0000-0202, LC 0203-1459
21OCT: SC 0900-1800
22OCT: SICK
23OCT: SICK
24OCT: LC 0000-1159 (Called in well at 0530)
25OCT: SC 0600-1500. Assigned 27OCT 1-day trip.
26OCT: LC day. At 0800, Received voicemail saying GS that departs at 1000 (in two hours) is denied, and I will be put in rest at 0830 making me legal for 27OCT 1530 report 1-day trip reserve assignment.
27OCT: Report at 1530 for 1-day trip reserve assignment.

I'm kind of lost on this one. I would have thought that sick time is free of duty and qualifies as rest for 30/168. Additionally, I thought I had 10 hours of rest before report (even though on long call). Could someone please shed some light on this case? Thank you for your help.

I started SC last Sunday at 1000 and have been on duty straight through with no 30 hour break. I was just assigned another SC for tomorrow (Friday) at 1000 and was curious as to how long they can use me.

FAR 177 says this:

“30-in-168” Before beginning any reserve availability period (RAP) or FDP, a pilot must have received
at least 30 consecutive hours free of duty within the 168 consecutive hours (seven 24-hour periods)
immediately preceding the start of the RAP or FDP.

So do I go back to 30 hours prior to starting SC at 1000 on Sunday, which would be 0400 of last Saturday and go forward 168 hours?

If so, starting at 0400 on Saturday and going forward 168 takes me until this coming Saturday at 0400. What confuses me is the verbiage "... preceding the start ...." Do I need to be finished by this time or can I start a trip up to this time?

I think I am good to start a duty period tomorrow since I meet the 168 hour look-back but could not fly on Saturday. I guess they could fly me somewhere tomorrow and DH me home on Saturday.

I called DALPA earlier today- got the voicemail and they blew me off all day. :(

I called scheduling talked to two different schedulers, neither of which could give me drop dead time but both assured me the WOPR would flag any illegal assignment.

Any FAR 117 Ninjas out there?

Scoop

There is a recent Engage podcast that does a great job explaining the 30-168. Easiest thing is this: take your first duty period, in this case Sunday at 10am. Go to the next Sunday, minus 6 hours. Start before then, you’re good to be assigned something.

If you are legal to start the FDP/duty day/SC/ you’re legal to be assigned something even if it goes past 30/168. The 30/168 is only for the beginning of a shift

You cannot be actively on LC and be awarded a GS containing an FDP unless it is at least 10 hours from award to report in order to be legal. You can be awarded a GS that reports in 1 minute while on LC if it starts with a DH-only duty period.

As to the 30/168, sick should be considered rest since you have no obligation to the company. Having said that, scheduling can assign you rest whenever they want even if it doesn’t make sense.

Sick has some funny affects on green slips. I’ve run into it once before where I was not awarded a GS because had I flown the trip I sicked out for, I would not have been legal. I think it can be awarded, you’re just put at the very back of the line. Basically trying to prevent you from sicking out, then calling in well a GS over your original trip. You really need to dig into PWA or talk to a real expert on that one.

This is correct.

It is correct for line holders only. A reserve can call in sick for an assigned rotation and it will not affect their standing on any future GS roster.

Scoop

When it comes to 30/168 rest it's "legal to start legal to finish."

Start at 1000 Friday (the start of your RAP) and go back 168 hrs (7 days to the hour.) Is there a 30 prospective rest period? If so you can complete that RAP. Now, if they assign you an FDP during that RAP, that would be a second calculation.

Is there a rule preventing a line holder from WSing a trip which disrupts a 30 hour rest therefore making it illegal for them to start an awarded trip on a future date that is currently on their line? Asking for a friend.
