we can lawyer the heck out of this flight all these years later, if you want. Or we can look at the underlying issue. IMO, If the FAA wants to violate you they will. Even if you think you are in the right or have policy on your side.

of course this is pretty much moot anyway as an ASAP would most likely absolve the pilots.

maybe, but you seem to think “the more” is nefarious or incompetent pilots. I disagree. I guess because neither of us was there we will never know.

And, you want to compare Delta today to AE of that time. Did they have Delta meteorology? I can’t speak to what rules or exceptions they had at the time.

I doubt they willfully took off without having required weather. I’m supported by the fact that one pilot fought and had it overturned. If you don’t buy it, so be it.

you think the weather requirements of a decade or two ago are materially different than today? We’ve always needed more weather than what’s on the flight plan to go since I’ve been in the industry, and not only at delta. The FOM is a reflection of the 121 regs on wx

no, I don’t, but your contention is that they didn’t have it based on ASOS being out. While, citing Delta’s FOM. And yes, I know what the FOM says and how it’s derived. Another poster gave an example of how the obligation could have been met. I have no idea how they met it, never indicated that, but I believe they did. Again, based on one pilots FAA action overturn. The point Is the FAA violated and asked questions later, at the time.

obviously, we can do this all day. You can’t prove it was a willful violation, and I can’t prove that it wasn’t.
Again, if you don’t think you can do everything right, and still get violated so be it.
