JV Settlement A Must Read
 
If you want to read an excellent example of precise and unambiguous legal drafting, you should read the attached JV Settlement Agreement. It was written by seasoned legal professionals, experts in contract law.

Unfortunately for the DAL pilots though, these experts were sitting opposite from Mike Donatelli and Hartley Phinney.

It will only take a couple of minutes of your time to read. As you read each line, ask yourself "who benefits from this provision"?

You don't have to be a lawyer to recognize just how one sided the Settlement Agreement is.

How is it that Donatelli and Phinney agreed, on their own without MEC input or approval, to such a lopsided “deal” and then kept the terms of that “deal” secret from both the MEC and the pilot group? Can someone explain that to me?

It's also available on the Delta pilot website, been there since August of last year. You can find several grievance resolutions posted there, including the Duty Rig grievance, by going to Committees>Contract Administration>Grievance Resolutions.

Before reading this, I thought it was perfectly reasonable for the union to be demanding retirement contributions from the company above and beyond the $30M settlement. But paragraph 6H pretty much closes that door, and Donatelli signed it. What am I missing?

I didn't think the union was demanding retirement contributions from the $30m settlement. I thought the issue was whether the $30m was subject to profit sharing.

CA Bulletin 16-05 Status of the Profit Sharing Grievances : "The MEC Chairman filed grievance 16-01 over the exclusion of the Delta/Air France/KLM/Alitalia JV settlement distribution monies in the computation of pilots’ annual compensation during the 2015 profit sharing year."

Is there a grievance involving DC contributions?
