The forums are for *****ing, taking it out on the passengers, or at work is uncalled for. The passengers are innocent, and don't deserve to be treated poorly. Some might think the passengers are getting a steal on flying, and should pay more, but that isn't the fault of the passengers. We are the ones who sell tickets below cost.

We can't have our Weight data report issued planning to be overweight (it's a centrally generated datalink), however if it looks like we'll be a bit overweight for landing, the FAA now prefers we just land and write it up instead of doing crazy manuevering and dragging the plane around going into busy airports. So, yes.. an emergency declaration is not required.

I could be wrong but I'm pretty sure that is actually a reg.

this explanation you gave is much different than how I read/interpreted your first post on the topic. I am now on the same page. I originally read it as, we gonna be too heavy to land, oh well let's just go anyway.

The reg is FAR 121.195 and it's clear you can't take off with more fuel than what will bring you under max landing weight considering planned fuel burn.

Yeah, after he clarified I admitted to interpreting his post wrong.
