He had to have been a heavy drinker for some time to be able to function with a .35 BAC.
I flew with a pilot once who was divorced and remarried now living in Texas with a couple of stepkids. His kids from the 1st marriage lived with their Mom in NC. His ex was an alcoholic but had primary custody. She got a DUI. On her Court Date an LEO saw her driving erratically in the Court House parking lot. She blew a .28BAC. Didn't make it to the hearing. NC didn't want to give up the kids, they placed them with an Aunt in state. The pilot had to have Texas Social Workers come out to his house and inspect it and jump thru a bunch more hoops before the court transferred custody.
