Warning: This appears to be a TEXTBOOK SCAM!!!
Lawyers have sued Bombarier in a false/phony/fraudulent claim that the aircraft is defective in that there was supposedly no "protection" of the pax from the fuel system. They also supposedly claim that the aircraft should have had a runway awareness system, something which is not required to exist. There exists, at the time of this filing, strong evidence contrary to all claims.
Here's what REALLY happened: In an attempt to maximize revenue for their personal injury BUSINESSES and maximize the amount of money they can shove in their pockets, the laywers fabricated an openly phony LIE about the aircraft fuel system design. They then pitched the phony story line to family members, in this case the estate of one Ms. Kathlene Moscoe, and got them to be the subject of the filing (the technical term is "PATSY"). THIS APPEARS TO BE A TEXTBOOK SCAM!!!! I'd recomment the Comair cheif pilots and representatives from Bombarier contact the Kentucky State Attorney General's Office about this. The company I work for was recently taken by one of these scams, although on a much much smaller scale.
BTW, did you ever notice how people who sue always keep the asking amount a secret ("unspecified damages"). I wonder what they're afraid of

21 years, and I'm just starting to investigate this. Turns out to be an all too common occurance. Insurance fruad is an $86 billion a year industry, and occording to the National Insurance Crime Bureau, roughly 10% of all the personal injury claims made are scams committed by professional con artist. The above details what's knows as "opportunistic" fraud. No one's really sure what percentage of personal injury claims are of that nature, but my estimates put it at an additional 20 to 40 percent.

I'm assuming you cut and pasted? Pretty loaded speech.
In this country, people have the right to sue for anything they think they can get their hands on. It's up to judges and juries to decide if the suit has merit and warrants an award.
Ambulance chasing lawyers have been doing this for as long as ambulance chasing lawyers have existed. Don't take it personally. Let it play out in court.

There should be penalties for bringing BS lawsuits. Lawyers can just throw these scams out left and right and eventually one pays out. I vote for fines + a few months in jail. Lawyers are making prices go up for all consumers not to mention wasting tax payer money in court.

There are a very few legit lawsuits that get filed, and this kind of system would essentially prevent the little guy from EVER suing corporate america because he couldn't afford to pay for the company's army of attornies in the event he loses his case. Management would take this one to the bank...
Actually most or all jurisdictions have provisions for the plaintiff to pay the defendents fees in the event that the suit is found to be frivolous...unfortunately this doesn't get applied as often as it should.
