PRIA Question...

I just changed jobs and filled out all the PRIA paperwork and like a good pilot I checked the little box that says "send me a copy of my stuff". Well today I get a letter back from my last employer stating:

"We are required to notify you that pursuant to Section 502 of PRIA, you have the right to a copy of the same records that will be supplied to the inquiring company. You indicated that you would like a copy of your records, however, please forward your written request with a check for $35.00 for your records, payable to:..."

First off, didnt I already send my written request with the PRIA record paperwork and second, WHAT THE HELL are they making a profit from me for my records? Has anyone else had this problem (I havent with any of my other employers). Is this legal? Thoughts? Suggestions??

If you read the original PRIA form, it states that the operator may charge you a fee for the cost of sending you the records. I used to request a copy, but last round I just requested a copy from the FAA for that exact reason. If there is any reason you suspect an inaccurate response, pay the fee.

The FAA doesnt send you anyting but a copy of your certs. What good does that do for your training records?

Yes, they can charge a fee. I would pay it though, that way you know what kind of dirt they have on you.

Does the FAA also get a copy of each PRIA return? I hadn't heard of that before.

Well, I emailed the FAA about it and here was their response:

"The company certainly has the responsibility to process an additional copy of your records for you if you checked the "yes" block on form 8060-11A, which you state that you did.
This should be all that you need, and not have to submit an additional
letter of request. I have never heard of a company requiring an
additional request other than that on the 8060-11A.

Next issue is the charge, and the answer is yes, they can charge a fee
for the copying of the records. $35.00 is slightly high but not
unreasonable. I have had to help with cases where the company wanted as much as $300.00 for the records, both from the requestor and the pilot. In addition, they do not have the authority to withhold your records until receipt of your check, but many companies do, knowing full well that there is really nothing (in real life) that the FAA has time to take care of. We just
depend on the honesty and integrity of the companies to do what is
right. I would suggest that you send a letter with your check that simply
states that "this is for your copy of the records requested on FAA Form
8060-11A, in accordance with 49 U.S.C. section 44703(h)(6)( and (7)."

Helpful but not the answer I wanted ;) All well, there it is for future generations.

Nothing for your training records. If you want those, you might have to pony up as stated. The FAA will show your certs and any certificate actions taken. I know its free, so I get it. The problem with the employer is that they can send you the paperwork, then demand payment after you receive it. I don't know what the fee is up front and I don't want to get into a fight over a $300 bill like described above. If there is nothing in your record to fear, then I would't worry about it.

I just checked no. If you look at the questions they are stuff like "did he /she refuse or fail drug screen" Yes/ NO..... So unless the former employer is going to lie or you really screwed up then theres nothing to see.

Hello All!

What is the easiest way to get a copy of the PRIA if you've previously worked for a 121 carrier but don't currently? How long does a carrier have to report info on the PRIA after separation? Thanks.
