Countdown to the Mesa vs. Delta hearing on 01/30/2009
 
I wanted to get opinions on what you guys think the outcome of the hearing will be.

Something along these lines:

JO delivers some cash in a suitcase to RA's house about 2am. RA and Delta "misplace" important information, and JO's computer "crashes" yet again. Both show up in court and stare at the judge and just shrug. Both walk out, sharing a knowing smile.

Wash, rinse, repeat every few years.

There is a 50% chance of Delta winning, though the chances of that happening are only 50%.

if Delta wins, does Comair get the A/C back, drain the pool, and start hiring again? There's a 50% chance of that.

How will the judge decide? In previous decisions, statistics indicate it could go 50% for Delta or Mesa, but experience seems to suggest 50%

How is this running joke? I think 50% of you may get it, but I could be 50% wrong.

As I said in a different thread. Delta wouldn't be pursuing this if they didn't think they would win. People are saying otherwise, but it's been quoted by the judge who issued the injunction, that the injunction was ONLY GRANTED because he DIDN'T WANT TO PUT THE COMPANY OUT OF BUSINESS WITH ONE SWING OF THE GAVEL. He wanted all the information presented.

Again..Delta would NOT be pursuing this if they didn't think they would win, and Mesa has NO CHOICE but to fight it, because frankly...they most likely WILL go out of business without that $20 mil a month.

Andy's right, at first i posted that i thought there would be a settlement, but they would have reached one by now. DAL must really want the contract terminated, because of the resources they were willing to commit to this legal battle.

Chautauqua gave Delta the 135s back without a fight and "possibly" a verbal agreement that Delta would pursue the injunction. Maybe BB laid down the 135s because he knew that Delta kicking Mesa to the curb meant that there would be more Delta 175s, United 170s and a ton of Airways flying.. He knows more than we do or maybe I just had two bottles of wine and 4 Sierra Nevadas.

If anyone here really knew what they were talking about, they would know delta wants to cut capacity at the 50 seat regional level. However to do so, it is stipulated in the wholey owned contracts, (comair) that delta must make every attempt to rid of capacity at other regional airlines before they can drop it to a certain level there.

The injuction was granted because the judge felt that Mesa must have a compelling case...it's that simple. They stand a very realistic chance of winning the case. Doesn't mean they will, but there is a chance. No judge is going to refrain from banging the gavel out of pity for the other side. Will Mesa or Delta win? Who knows. Mesa probably has a better case than most would suspect...What I would be asking:

1.) Which judge is hearing this next case...is he/she the same judge who granted the injunction? What is their track record in such cases?

2.) What are the previous outcomes for cases like this where a business, such as Mesa in this case, won the injunction and went on to win the case?

It's a significant case because it has far-ranging implications for both parties. For Mesa, continuing revenue stream and trying to stay alive while money in this country is scarce. For Delta, this will set a precedent and will dictate how they'll continue to restructure their regional feed. In this sense, the final decision will also directly affect other regional airlines besides Mesa.

Don't forget, If Delta wins, that will set a precedent for everyone else, remember, United, USAIR and a few others are looking to dump Mesa but they are all waiting to see if Delta wins. If they do, and I hope like hell they do, look for some RFP's to go out.

Since it included turboprop flying out of DEN (among other things), the obvious assumption is that it is for the ex-mesa flying. It appears to be a precautionary thing, in case mag shuts down. I don't think UAL has immediate plans to fire mesa.
