First Pinnacolaba JCBA Loophole found!

Section 12.F.1. "Scheduled RON Rest"

A Pilot will be scheduled for a minimum of nine (9) hours of rest between Duty Periods at all locations other than his Domicile. However, with the approval of the Association Scheduling Committee, the minimum rest period away from Domicile may be scheduled for less than nine (9) hours. Such approval will be made on a monthly basis and will be hotel specific.

So how did the JNC and more specifically the Mesaba contract folks not see this giant Mac Truck of a loophole? I really love dropping to FAR min rest CONTRACTUALLY...

Control is still in the hands of our scheduling committee, no?

Any rest < 9 hours is unacceptable. Especially since contracts are supposed to provide a buffer from FAA minimum standards.

Sure control is there, but if my duty day goes long and I had a 9 hr overnight, I could drop easily to min 7:45 including transport time.

7:45 min in hotel also required in JCBA. Transportation TO the hotel not included.

As stated you must have 8 actual (or 9 if needed for FAR legality). The scheduling cmte can go below 9 for pairings IF we agree. Example- 15.5 block MEM 2-day with 8:30 RR in HSV since hotel is nice and IN the airport. That's better than an inefficient 3 day with 19:20 rest in the HSV airport. Not a loophole but an option (our side only) for being efficient and more days off.

Well that is nice, but how about no less than 9 scheduled OR rescheduled without concurrence of the flight crew.

I've used this line and it's only applicable to scheduled as stated, delay causes you to arrive at overnight under 9 but at least 8, you're FAR legal baby, BOHICA

It's all about negotiating capital. The fact we couldn't use negotiating capital to protect us from FAR minimums tells me that Mesaba's mainline contract wasn't exactly that great.
