Dear Fellow Pilot:

Now that United has accepted the Integrated Seniority List, UPA LOA 24 provides for distribution of the second tranche retro/lump sum payments. The total for the second tranche is $150 million.

ALPA’s Administrative Manual, Section 40 Part 3.J, as adopted by elected officials throughout the union, provided pilots who disagreed with the CAL and UAL MEC distribution models a means to dispute the MEC allocation.

Earlier this year, a number of pilots brought their disputes to the ALPA Executive Council, and some cases went on to a neutral arbitrator because the pilots were dissatisfied with the council’s decision. Both the Executive Council (with one exception) and the neutral arbitrator upheld the methodologies employed by the UAL and CAL MECs.

With that internal dispute process over, and the ISL completed, ALPA was preparing to direct United Airlines to make the second tranche distribution as authorized by LOA 24.

Unfortunately, last week, ALPA was served with two new lawsuits in two different federal district courts by pilots, in effect, suing their fellow pilots to take more of the distribution money for themselves.

These suits are in addition to another preexisting class action suit and several administrative complaints regarding the retro/lump sum allocation.


In order to protect your money, the ALPA Executive Council has to decide how much to hold back from the second tranche (in addition to the 5 percent from the first tranche) as a reserve against these new lawsuits.

I will brief the Executive Council as soon as possible and will ask them to permit the distribution of the maximum amount that we can prudently permit without jeopardizing your money.

I will let you know as soon as we have a decision.

Yeah, I'm done. Took my ALPA pin off just now. They might as well just keep it all. They're going to need it, because the lawsuits aren't going to stop.

At the same time, who are these pilots who just NOW decided they didn't like the methodology and are going to sue? I'd like to know, because as far as I'm concerned they should be responsible for paying all of us the interest on the withheld money. In addition if this holdback goes into next year, they should be paying 6% of the withheld sum to each pilot whose earnings go above the FICA limit this year. So disgusted and feel I have the right to express this to the pilots responsible

I suggest we start collecting funds and sue for the interest lost.

What is very ironic is last week the pilot groups were delivered a ISL that many felt was polarizing. However, tonight ALPA has done a wonderful job of uniting this pilot group in a way that they probably never imagined. All 12,000+ of us that have just been told there will be no Christmas, while ALPA national worries about lawsuits are united AGAINST ALPA. We are all brother in arms no matter if your % is based on '10 or '13. For once we ALL have a common enemy, no JH or JP, no Bruicia, Katz or Esichen. The enemy is ALPA and the Moak regime.

If anyone is still contributing to the PAC please stop. Burn the laynards and drop the pins. ALPA's days on the UA property should be numbered.

How about directing this anger where it belongs? With the jack wipes that are bringing the lawsuits. ALPA really has no choice but to protect itself from a possible judgement against it. We are talking single digit holdbacks here. It SUCKS! But that's what you get with our BS litigious society. My guess is we will get our money, all of it, but not until these court challenges are dealt with.

Does anybody seriously think it would be different with any other union when it's our fellow pilots filing the suits?

(This is not an endorsement of ALPA or a slam against ALPA)
