I have a question regarding the authorization of an ATP giving flight instruction. FAR 61.167 (a)(2)(i) states that an ATP may instruct

"Other pilots in air transportation service in aircraft of the category, class, and type, as applicable, for which the airline transport pilot is rated and endorse the logbook or other training record of the person to whom training has been given.."

Does this mean that a pilot that holds an ATP with a multiengine rating is authorized to conduct training, including an IPC, in a multiengine aircraft that does NOT require a type rating, ie a baron, twin cessna, etc?

My interpretation has always been that an ATP may instruct a pilot in air transportation under a 135 or 121 certificate, and only in aircraft in which the ATP is type rated.

The question recently arose as a fellow at our local field has been doing checkouts and IPC's in multiengine aircraft, yet is not a CFI.
My opinion and interpretation seems to be in the minority...

Your opinión has always been my understanding too...that it had to be training given in the aircraft for which the ATP holds a type rating or rating for training at an air carrier. Meaning for the company they work for to get the SIC's trained in the aircraft and company ops.

What he's doing doesn't sound right, I can't see why your opinion is in the minority. I googled it and couldn't find anything that backs up that work-around a CFI certificate. I'd tell that guy to stop eating crap or give the FSDO a call if he keeps it up....

The scope of the regulation regarding an ATP providing instruction has been interpreted by FAA Chief Legal counsel on multiple occasions. An ATP may NOT provide instruction based on his or her ATP certificate outside of air transport operations. These have been defined as company operations within a narrow framework.

One cannot, for example, teach a company mechanic to fly. One needs to be instructing other line pilots under an operating certificate, in airline operations, and then within the context and performance of official duties.

Jumping in the rental Geronimo and giving instruction to the local yokels does NOT qualify.

The cliff notes version is that the training has to be part of an approved 121 or 135 training program in order for an ATP-only holder to provide training.

Checkouts for a FBO would be one thing, there's no legal requirement, only insurance. An IPC that goes into a logbook to show currency, no.

The checkouts are technically legal, insurance issues notwithstanding, but the IPC's are not. Someone needs to set him straight because both he and the people he is signing off will run afoul of the FAA if something untoward happens.
