Juries can, and DO, glom onto tangental bits of arguments, and use them as justification to render lame verdicts. Anybody think OJ didn't do it? Other than the 12 jurists, I mean.... The TWA MEC, with urine running down their pants legs, made the call...and now claim "information was withheld". Yeah...and the glove didn't fit.
AA should have let TWA go Chapter 7. Same number of "victims", but no lawsuit. The TWA plaintiffs spilled hot coffee in their laps, and sued McDonalds.
There's "claiming information was withheld" ...and there is willful destruction of thousands of emails, the computers and hard drives of the parties involved and the destruction of the servers and backup files. That's WILLFULL destruction to cover your six.
ALPA almost got away with it. Sadly, they missed one computer. And the information was there, validating the claims of the TWA pilots.
This isn't an issue of AA letting them go bankrupt. This is a matter of a union that did not provide fair representation to their members.
Why would they do it? Dues money. If the deal was cut to the benefit of APA, then maybe down the road, they'd rejoin ALPA...at least that's what they SAID they'd do...and for ALPA, it was pure economics. Throw the TWA guys under the bus for a larger prize.
The politically elected officials will take the hit for this. The real fault...and guilt...lie with the General Manager who refused to join the union when he began working there, the Organizing department employee who sold his soul and then got caught destroying emails, and the lawyers who advised on this course of action. All of whom get big salaries while pilots have taken hits, all whom have nice retirement packages while pilots try to keep their bills paid.
Karnak is right about one thing...in this case a jury was presented with common sense arguments and facts. They didn't buy into the tap dance from ALPA. And the history of a great union is stained yet again by people whose arrogance in lying to the elected leadership was and is limitless, even in the face of being unmasked for the traitors to our profession that they are.
The very profession that has made them and their families very comfortable while those in the profession have suffered.
