I doubt it will be even that. During the initial trial, ALPA was barred from presenting evidence of what AMR management would have done if the scope waiver had not been approved by the TWA MEC (all TWA pilots by the way who somehow forgot how they voted).

During the damages trial, this evidence will HAVE to be admitted. Therefore, when AMR management testifies that they would have shut down TWA and transferred their assets in a liquidation, the damages will be shown to be zero.

Notwithstanding that there is no case in the first place, proving damages will be incredibly difficult. You never know with a jury, but the TWA pilots are in a difficult position when this evidence gets to trial. I am guessing legal fees and not much else in a settlement.
