Page 5 of the TA states that AA has a Flex Option to still release 20 aircraft per year for both 2014/2015 and 10 in 2016. If not replaced, financial penalties will be paid to the Association.
If AA decides not to replace the aircraft, AA agrees to one-time penalty payment of $250K per aircraft uncovered in 2014, $155K per aircraft in 2015 and $100K per aircraft in 2016 Any of the above penalty payments will be retained as a credit to the Association. The association will have the discretion concerning how this credit is used.
By the time this is over we will have gone 24 years without a Section 6.
