Actually, Continental pilots contract specifically states that they aren't required to cross a legal picket line (UAL contract has a similar clause). No excuses.

should settle the matter, but pro-management courts have been known to enjoin actions which are completely legal and allowed by the contract. Their reasoning: "Because you are in contract negotiations, we think you are attempting to circumvent the 'status quo' rule and pressure the company without getting a release."
Management carefully chooses such a court before filing its petition for injunctive relief.
