The question will be, did ground tell EVA to give way to the ERJ or not, because I think that will point the blame. However the blame will still get put on EVA since by the pics it looks like the right wheels were on the center line, which means they were cognitive of the fact they were trying to get around the ERJ. Not sure how it could be Eagles fault, except maybe that it takes 15 minutes to get rampers at ORD.
I don't see how Ground could be blamed for this. No matter what clearance they give you, it is your responsibility to not hit other airplanes when taxiing around.
