Yes. EWR tower does not like to switch from 22's to 4's, and there is plenty of backlash/resistance to switch, specially if they got a departure push coming.
Do you remember a few years ago at JFK, there was an American that declared an emergency because of runway/winds? What ever came out of that if anything? If a guy at EWR can't accept the runway, are they just forced to divert?
