That's a crapshoot and should that occur, they're SOL. On the other hand, the inclusion of West pilots on USAPA's committee would at least guarantee them some participation in the process. Seems like a dicey concept though considering the polar opposite positions on the Nic. Perhaps AOL has come to terms that inclusion or not, a pure Nic based final ISL isn't likely anyway ?
I don't know that the West guys could ever change their "Nic or Nothing" strategy. I really don't. At this point half the value of the Nic lottery ticket is gone (unless the West really thinks they should have unrestricted access to the 777's---and some do). For some its the principle they believe in. Whatever. Nic or Nothing works for me.

But I do agree with you that the Preliminary Arbitration is a risk for the West, just like at Wye River. How does an arbitration panel now award something that a judge said they were not entitled to?
