I don't know that the West guys could ever change their "Nic or Nothing" strategy. I really don't. At this point half the value of the Nic lottery ticket is gone (unless the West really thinks they should have unrestricted access to the 777's---and some do). For some its the principle they believe in. Whatever. Nic or Nothing works for me. 
But I do agree with you that the Preliminary Arbitration is a risk for the West, just like at Wye River. How does an arbitration panel now award something that a judge said they were not entitled to?

The settlement would be offered to each and every individual west pilot. If the majority signed it would dissolve the west class. I doubt AOL will capitulate.
Without Nic there is additional exposure to the West that AOL may be starting to acknowledge.

The settlement would be offered to each and every individual west pilot. If the majority signed it would dissolve the west class. I doubt AOL will capitulate.
Without Nic there is additional exposure to the West that AOL may be starting to acknowledge.

Let's assume the West gets a seat at the table (a risky assumption for the West, but let's assume..)...
All merger committees will necessarily agree to the terms of the Protocol Agreement to enter the room with the SLI Arbitrators... AOL is smoking crack if they don't realize what that means...
All the risk is with the West, just like at Wye River. If they are denied an independent merger committee then they are outside looking in... if they are granted a merger committee then they are guests according to the terms of the PA that APA and USAPA negotiated..
APA and USAPA have demonstrated an ability to negotiate an agreeable settlement to avoid needless lawsuits...
AOL has a choice to make, be carried along for the ride and continue to scream about imminent victory, until the bitter end, or get involved in a better solution of their own choosing.
Time to watch Uncle Bob again..
