Let's assume the West gets a seat at the table (a risky assumption for the West, but let's assume..)...
All merger committees will necessarily agree to the terms of the Protocol Agreement to enter the room with the SLI Arbitrators... AOL is smoking crack if they don't realize what that means...
All the risk is with the West, just like at Wye River. If they are denied an independent merger committee then they are outside looking in... if they are granted a merger committee then they are guests according to the terms of the PA that APA and USAPA negotiated..
APA and USAPA have demonstrated an ability to negotiate an agreeable settlement to avoid needless lawsuits...
AOL has a choice to make, be carried along for the ride and continue to scream about imminent victory, until the bitter end, or get involved in a better solution of their own choosing.
