Default Judge Silver rules

This could go under the AOL update thread, but I believe few read it and this involves all AA pilots. Judge Silver ruled in USAPA's favor, but with some cross words for them.

"A group of pilots formerly employed by America West Airlines, Inc., and their new
union, have a long-standing disagreement regarding pilot seniority. Unfortunately, there is
no perfect solution to that disagreement. The Court finds the former America West pilots
have not established the new union breached its duty of fair representation. In addition, the
former America West pilots are not entitled to participate in the upcoming statutory
procedure required for the integration of the US Airways and American Airline pilots."

Let's move on.

And when USAPA is no longer the
12 certified representative, it must immediately stop participating in the seniority integration.
Hmmm when is the arbitration timeline?

Hmmm when will you let it go? Good luck trying to enjoy the rest of your career like a normal person might.

Just pointing out that under her order usapa will not participate in MB if apa takes over on proposed schedule. Am I wrong?

And when usapa is no longer your rep apa will be. and they don't care about your attempted loopholes either. Sorry, you didnt win the lottery. Like most people dont.

I'm not an attorney, but I don't believe that is in her ORDER. It's her opinion, but I believe she is wrong. That defies the intent of MB and the MOU.

You won big today for sure, but she gave us enough nuggets to play with. For example the "Nicolau" hasn't been abondoned yet according to her so we will see how this plays out going forward

Silver is a better politician than a student of law. She throws out words to make everyone feel like they sorta got a trophy too.

Before you send Martay, Fergie and Konnn some more money.. Go read up on the history of lawsuits between pilot groups and see if you can spot the winners. And listen to some Kenny Rogers... "The Gambler"
