I disagree. I'd say it's 100% completely on the future employee. If you are offered a job based on what you disclose on your resume and application, that is all the company knows about you. They are hiring you based off of that. If you blatantly leave off failed check rides, legal issues, or prior negative work history, and the company learns of these things during indoc, that's on YOU. Of the two parties, you were the only one who knew the real story. You can't fault a company for giving you an opportunity, and then YOU blowing it by lying or deceiving. If it ruins your career, it ruins your career. But why is that the company's fault? That is the gamble one chooses to take by lying and deceiving.

Choices are; disclose everything, OR don't disclose everything but understand the consequences.
