We are effectively in an annual review period now.
Every April 1, we can look back 3 years and after a year's wait grieve the violation of the PWA.
We've been unable to do anything about flying less than what's in the PWA since this was signed in 2010. The grievance isn't a gain, but a contractually triggered event that will occur annually until the company can bring the 3-year look-back to within 1.5% of 50% EASKs.
We are now in the "payoff" part of this agreement and will be able to grieve annually unless Delta increases our portion of the Transatlantic JV flying or the Europeans decrease their portion.
The only contractual measurement that is "grieve able" is the 3-year look back measured every March 31.

Once the company, at the end of a 3 years period, averages 48.5%, it will be considered in compliance with the PWA.
