Every pilot who has been hired since DGI came out has been made a promise in writing. It is then a contract between the pilots and 9E and Delta. Even though ALPA isn't involved the lawyers would be if It is taken away. It's no different unless it states that It can be taken away at any time.
Its not about it being taken away, the program makes very little in promises and the SSP already has presendence for delaying pilots movement until the union sealed up the language. There is a lawsuit every time a seniority list is integrated and nothing happens. Delta and Endeavor made it clear they want this program to try and attract and retain pilots, they do not want to be held to specifics when plans change. You have something in place with no enforcement. You can sue as much as you want, it takes no work on the company's part to say, "hey we are still fulfilling our 'promise' within these interpretted parameters."
