Well since you specifically asked for MHO, I think the out the Company is using is contained in section 1 of your contract quote. They are treating it as a "both 1 and 2 must be met" type situation.

1. AVA shall be available and assigned to all eligible pilots beginning 7 days prior to showtime for that assignment, based on the reserve forecast.

Since the reserve forcast for your seat is way more reserves than open time, no AVA, despite the provisions of section 2 being met.
