In theory you are right, but there are still operator who prefer to stick their head in the sand. I worked for a large 135 company and brought the Whitlow letter with me in training and told management (politely) how our policies were not in line with the FAA. I was told, "We have been in the business for 30 years and no one every brought that up, so I don't think it is a concern." A few months later I was told that since our POI signed off on our policies and we could always call out fatigued if we didn't feel comfortable with the trip that it was legal. Luckily they realized that the money saved by ignoring the FAA was not worth the legal risk and decided to end our 24 hour on call policy 6 months later.
