Short answer is that it's required by the supplemental type certificate.

The FAA denied an Erikson request to do a flap-40 gear-up drop configuration a couple of years ago.

The MD80's were still doing gear-down drops as of last summer fire season, but have hoped for approval to do gear-up this year.
