I agree with mostly everything you’ve posted in regards to the pilots failing to fly the airplane correctly. However there is a huge amount of precedence in aviation showing that nothing which is inherent to the flight control systems or computers controlling them should be designed with a single point of failure, that’s what they did. Is it criminal? I don’t know. I’m not a lawyer. But the smart people at Boeing who are designing these systems have decided to lawyer up. Probably not a bad idea, I’d do the same if I were them.
