The most important thing to take away from the uploaded tail idea is that if an uncommanded nose up occurs during flap retraction put the flaps back to where they were. Cessna has no procedure for recovering from an uncommanded nose up. So, Amigo, training pilots what to do should it occur is not contradicting Cessna.
The upload on the tail is main point here. You mention that it was disproven in court. Why don't you tell us how it was disproven?
