Normally a contract would not be written where one side is free to simply not perform, it would not really amount to a contract. What is in the contract is what controls, absent some violation of a public policy (i.e. contract for sex). I am not sure what do you mean. In our CBA, there is no mention of bonuses, it does not prohibit them either. For those of us that were street CAs and were able to receive part of the bonus, the only "contract" that was signed was a promissory note, where you committed to attend all of the training up to IOE. There is nothing else in writing about future bonuses, other than what the company advertised on their website. The company has announced the suspension of all bonus programs. So again what contract would you like to have?
