while I would not rat a guy out to the FAA for something like that(not by a longshot), the guy filming this was wrong as far as FAR/AIM is concerned.
moral of the story, don't post a video of you flying online unless you are willing to have every facet dissected by everyone out there.
There's no regulatory allowance for pilots to do it, but it's not unreasonable. An utterly irrelevant technical violation is not necessarily an actual violation of the law, and that is established legal precedent: De Minimis
He'll get nothing worse than compliance philosophy anyway. I have no problem with him standing up to this, it's BS and waste of taxpayer dollars.
