The regulation of aviation, airlines, and federal employees (ie contractors) is exceptionally well-established federal jurisdiction. Tilting at constitutional windmills will get you nowhere... IMO you need to find a weakness in the broad application of contractor status to all airline employees. Or distance this matter a great deal from Jacobson.
