It very clearly says (at least it did a few months ago) in the FOM a Captain can give any open cabin seat to a jumpseater. I’ve pointed this out a few times to hesitant captains coming back from Europe in the winter when flights are empty. They have always been glad I showed them. I’ve gone back more than once to move the jumpseater up to a better seat.
