At Delta, it was neither vacations nor sick leave that were at issue. Rather, it was a noticeable drop-off in the number of overtime volunteer bids ("greenslips"). As I recall, over 40 subpoenas were issued, not for failing to volunteer, but for urging others not to volunteer and (allegedly) harassing those who did volunteer. The matter was finally dropped, but only after DALPA virtually pleaded with members to cease all "no overtime" campaigns.
I'm not qualified to give advice, but your union should have a legal department which can answer questions about this.
