The key is 24.AA.2.b.1 where there is no allowance for the FRB to exclude a case where the pilot is fatigued, regardless of the underlying causes. You are either fatigued (accepted) or sick/personal issues (excluded). There is no allowance to mix those two together. If the leadership of our union ends up disagreeing with that clear language then I don't know what to tell you. It would certainly have a chilling affect on the fatigue program if pilots know that the company would be able to nitpick details behind why you were fatigued in an effort to not pay you.
If they’re going to play that game, then every fatigue report should say nothing more than “I was fatigued due to lack of sleep.” Nothing beyond that is any of their business anyway.
