Failure to represent has been tried and has failed numerous times. The real sticking point is that the retirement age is a law passed by congress and it is further backed the bona fide occupational qualification carve out in the age discrimination employment act. It also has precedent from the other failed attempts which makes it a very flimsy case especially as most of the members oppose it.
