Racketeering is actionable both as a civil and a criminal offense.
If the company isn't going after it in court or handing it over to a criminal prosecutor, it's just hot air.
(Ironically the phrase was invented because of another union..the Teamsters, back in 1927. A "racket" back then was roughly defined as a service that calls forth it's own demand that wouldn't have been needed otherwise)
It's an interesting accusation. Doubt it will go anywhere or it would be in court by now.
