Do you know what an "injunction" is? Mesa/Freedom didn't win anything. They were granted an injunction, which in layman's terms means that they successfully (with the aid of the court) prohibited Delta from canceling their contract until the dispute can be taken to trial.
Mesa's/Freedom's performance is abysmal in JFK there is no denying that. You know how many times I have heard them calling out "on time" when they are over 30mins late. They have started fudging times ever since delta threatened to cancel them. Freedom simply has a poor product, and Delta has had enough.
If you want clear winners and losers, go and read up on the Aloha Vs. Mesa court case and what the outcome was. Although Aloha was sided upon by the courts they ultimately lost the war, filing for bankruptcy earlier this year.
Mesa Airlines clearly counted Alohas demise as a victory, so I really have no sympathy when I see them teetering on the cusp of bankruptcy, and loosing flying contracts.
The faster Mesa airlines "Go"es out of business, the better we will ALL be off in the long run.

While you are correct that Aloha passenger service has ceased, their lawsuit is not supposed to be heard until April I believe.
