From what I've been getting is when we went into Ch.11 with Delta; when they renegotiated the aircraft leases, Delta was able to get an early out clause if they needed to return aircraft before the leases were up, hence why we've been returning newer a/c with more expensive leases. Since they are considered "scheduled" lease returns, they can't be challanged by the side letter agreement on the contract.
I'd like to think the union had an official list of "scheduled lease returns" when they agreed to the side letter and brought the TA to us for a vote.
It would serve us right if Delta has the option to return the whole fleet in the next year and the union forgot to ask about that little detail, wouldn't it?
After all, it took them a year to publish the "new contract" for us because they were working on all the details... if Delta can just take the fleet away I think they missed a
really big detail.
