You're right that your employer can't disclose information about sick calls, but what your employer can tell your prospective employer is whether he would recommend you or rehire you. Lastly, if you're going to be sick for, let say a month, I believe you need FMLA paperwork filed by a doctor or a nurse.
I believe Hippa and privacy laws trump labor laws. Hippa laws don't allow the doctor to reveal medical info, even on FMLA paperwork. They can state that you aren't able to do your job. The company can ask when you'll return and the doc can give their best estimate.
Employers do not answer that question any longer. My wife does background checks and she can't remember the last time any company answered that question. All anyone does anymore is verify that they worked there for the specific time frame.
