It says "first" in the pairing because the pairing simply flags a higher class of service by using Y or F. The actual booking of the "higher" class must comply with the CBA and you are correct, <10hours is up to the CO. I would guess they somehow will always choose the cheaper option.
c. Higher Class of Service
i. If a higher class of service is authorized on a deadhead
with less than 10 scheduled block hours, such
service shall be booked in Business or First Class at
the Company’s option, subject to availability on the
scheduled flight.
