This is not intended as flamebait, but my sources tell me that Delta plans to liquidate Comair this fall to raise the cash to settle the LEX accident. This became firm last year when the KY Supreme Court ruled that the LEX airport board couldn't be sued to recoup the uncovered losses.
If it happens, it will be a sad end to a once great airline.
I don't believe 5191 has much to do with this. First, Delta is not liable for 5191. Comair is liable for 5191. Other than punitive damages for the Woodward case, which is set for a jury trial in July, 5191 is settled. Barring a case of severe judicial activism (which is possible), I'm convinced Comair and their lawyers have a good ballpark idea what this will cost them. This is surely factored into the accounting by now.
