Comair was fined because it was a Comair flight. It doesn't matter who boarded the passengers. Comair contracts out to other venders (ie Delta, Regional Elite, etc), but still retains responsibility of the flight. It is Comair's responsibility though.
You can tell whose resposible by who's PR person is doing the talking. Not a peep from our PR people! We are the Expendables! Our name gets put in the paper an we get the bad PR. Delta stays out of the lime light and tells everybody that they're wipping everyone into shape. Comair doesn't contract anything except maintenance at outstations. DL handles all and I mean all CS, whether it be DL, DGS, or RE. The only other thing I can think of is that it was while we still had CS and during the same period DL got smack with their fine for doing the same thing.
