In ORAC's defense, I think he is focused on this:

Not this:

Open skies - Wikipedia, the free encyclopedia

The first is a British Airways alter ego company, the second is the Open Skies accord. If after reading both and the previous posts, he thinks section 1 covers each, then there is nothing left to say.
