Yeah, we sure have lost in court a lot lately but don't ignore the reason of why we are losing, "ripeness" in our case as defined by the 9th circuit, the arbitrators will have no such worries.

Oh, I thought you meant with us in an order like we were on the Nic, not the Nic type process. That was more slotting by equipment thought. If the panel does that with the staus quo, it will look nothing like the old Nic order.

Btw I will reiterate, in my opinion, if the west has a seat the sli there is a better than even chance the usairways pilots will be in Nicolau order.

They won't be worried about ripeness. That's a legal thing.

I give it less than 10 percent, west committee or not.

Oh sorry misunderstood your point. Yes, I believe the usairways pilots will be in Nic order or close to it in the final sli should the west have a seat. The disparity we have today is artificially caused by usapa and I'm confident the arbitrators will see thru that. Anything less would me an endorsement of east pilot tactics by the arbitrators

Just waiting on 9th to order a hearing. I hear we will drop the case if we get a seat.
