By the very terms of it (the contract) the SLI will be negotiated or arbitrated and will be both "fair and equitable" and immediately contractual in the new JCBA. So we will all proceed with a "fair and equitable" SLI. Anyone who thinks otherwise is wasting time, and anyone who attempts to proceed otherwise is going to waste money.

We will all live happily ever after because the SLI will be a fair and equitable SLI.

About what?

I find the thought intriguing, but from a contractual perspective, any "agreement" between AOL and USAPA would by definition affect the Protocol Agreement, and thus would be subject to all the actual parties of the Protocol Agreement agreeing to renegotiate and amend the Protocol Agreement.

I like the idea of pilot leaders negotiating, but call me cynical.. when have we had pilot leaders willing to take the political risk of making a decision about seniority? :D

That's a crapshoot and should that occur, they're SOL. On the other hand, the inclusion of West pilots on USAPA's committee would at least guarantee them some participation in the process. Seems like a dicey concept though considering the polar opposite positions on the Nic. Perhaps AOL has come to terms that inclusion or not, a pure Nic based final ISL isn't likely anyway ?

The west had two members on the merger committee for a long time. They quit after some defeat.

I don't know that the West guys could ever change their "Nic or Nothing" strategy. I really don't. At this point half the value of the Nic lottery ticket is gone (unless the West really thinks they should have unrestricted access to the 777's---and some do). For some its the principle they believe in. Whatever. Nic or Nothing works for me. :D

But I do agree with you that the Preliminary Arbitration is a risk for the West, just like at Wye River. How does an arbitration panel now award something that a judge said they were not entitled to?
